Terms and Conditions (“Conditions”)

Please read these Terms and Conditions (“Conditions”) carefully before purchasing products or commissioning services from Barrette Fabrication, LLC DBA Ocean State Off Road (“us”, “we”, “our”, or the “Company”).


1. DISCLAIMER OF WARRANTIES

EXCEPT AS EXPRESSLY STATED HEREIN, ALL PRODUCTS, FABRICATION, AND SERVICES ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BARRETTE FABRICATION, LLC EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

  • Third-Party Products: Third-party items sold by the Company are warrantied solely by their respective manufacturers, not by Barrette Fabrication, LLC.
  • Limited Warranty on Rebuilt Items: Rebuilt items performed in-house are warrantied for three (3) months from the date of completion against defects in workmanship only. This warranty does NOT cover abuse, overloading, improper lubrication, neglect, or improper installation. All items must be shipped prepaid to our shop for inspection. We do not authorize or pay for outside repairs; ANY UNAUTHORIZED OUTSIDE REPAIR VOIDS THIS LIMITED WARRANTY. We are not responsible for labor costs, towing, loss of revenue, or general inconvenience.
  • Off-Road Use Only: Customer acknowledges and agrees that products, specialized equipment, and custom fabrications sold or performed by the Company are intended strictly for off-road events and off-highway use only. They are not intended or approved for use on public streets, highways, or Department of Transportation (DOT) maintained roads. No product or service is designed or intended to prevent injury or death.

2. ASSUMPTION OF RISK, INDEMNIFICATION & LIMITATION OF LIABILITY

  • Assumption of Risk: Customer fully understands and acknowledges that off-road driving, vehicle modifications, and non-OEM/DOT equipment carry inherent risks of severe vehicle damage, personal injury, and death. Customer voluntarily assumes all risks associated with the use, operation, and installation of products or custom assemblies purchased from or built by the Company.
  • Indemnification & Hold Harmless: Customer agrees to defend, indemnify, and hold harmless Barrette Fabrication, LLC, its members, officers, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to the use, operation, or installation of any products or custom fabrications.
  • Release of Liability: Customer waives, releases, and discharges Barrette Fabrication, LLC from any and all liability for injury, death, or property damage resulting from the purchase, installation, or use of any product or service provided.

3. SPECIAL ORDERS & CUSTOM FABRICATION

Barrette Fabrication, LLC reserves the right to require full prepayment for all special-order items, custom fabrication projects, and specialized assemblies. ALL SPECIAL ORDERS, CUSTOM FABRICATED ASSEMBLIES, AND DISCONTINUED/CLOSEOUT ITEMS ARE FINAL SALE. No returns, refunds, or exchanges will be accepted for these items.


4. ORDERS, CANCELLATIONS & REFUSALS

  • Cancellations: To cancel an order before it has shipped, you must contact us immediately by phone at (401) 822-0860 and speak directly to a representative. Email or voicemail cancellations are not guaranteed. If the order has not shipped, a full refund will be processed.
  • Shipped Cancellations / Refused Shipments: If an order has already shipped or is refused upon delivery, the customer is responsible for all original and return shipping freight charges, plus a 25% restocking fee.

5. SHIPPING, DAMAGE & SHORTAGES

  • Shipping Charges: Quoted shipping rates are estimates. Actual charges may vary for oversized items, truck freight, air delivery, or international shipments. Customers will be notified prior to shipment if costs differ from the initial quote.
  • Shipping Damage: Shipping damage must be reported to us within 24 hours of delivery. Customers must retain all original packaging materials so a claim can be filed with the carrier.
  • Shortages: Product shortages must be reported within 15 days of receiving the shipment.

6. RETURNS & REFUNDS

  • Return Approval: No returns will be accepted without prior authorization and a Return Merchandise Authorization (RMA) number issued by Barrette Fabrication, LLC.
  • Timeframe: Return requests for eligible stock items must be submitted within 15 days of receiving the product.
  • Conditions: Eligible returns must be unused, in original unaltered packaging, accompanied by the original invoice, and shipped prepaid.
  • Restocking Fee: Approved returns are subject to a 30% restocking fee. Original shipping fees are non-refundable.

7. VEHICLE STORAGE & MECHANIC’S LIENS

  • Storage Fees: Any customer vehicle left on the premises of Barrette Fabrication, LLC for more than thirty (30) days after completion of work (or notification of completion) will incur a storage fee of $25.00 per day.
  • Mechanic’s Lien: In accordance with Rhode Island state law, Barrette Fabrication, LLC reserves a possessory Mechanic’s Lien on any vehicle and its contents for all unpaid service charges, parts, and accrued storage fees. Vehicle will not be released until all balances are paid in full.

8. BODYWORK & FINISH WORK DISCLAIMER

Barrette Fabrication, LLC is not a licensed auto body shop. All custom metalwork, seams, and fabrications will be delivered in primer/bare finish with visible welds/seams. It is the customer’s sole responsibility to arrange for final body finish, sanding, and painting through a licensed third-party body shop.


9. PRIVACY POLICY

We respect your privacy. Personal information collected during ordering is used strictly to process orders and provide customer service. We do not sell or rent customer information to third parties.


10. SMS & TEXT MESSAGE NOTIFICATIONS

By providing your phone number and agreeing to these Conditions, or by opting in through our customer calendar/appointment portal, you explicitly consent to receive automated operational text messages (SMS) from Barrette Fabrication, LLC DBA Ocean State Off Road.

  • Message Types: Text messages are used primarily for transactional and service updates, including appointment reminders, drop-off/pick-up notifications, project status updates, and invoicing alerts.
  • Message Frequency: Message frequency varies depending on your active appointments and service schedule (typically 1–3 messages per appointment).
  • Cost: Message and data rates may apply depending on your wireless service provider plan.
  • Opt-Out Instructions: You may opt out of receiving SMS notifications at any time by replying STOP to any text message you receive from us. After sending STOP, you will receive one final confirmation text.
  • Help & Support: For help regarding SMS notifications, reply HELP to any message, call us directly at (401) 822-0860, or email our support team.
  • Privacy & Mobile Data: Mobile phone numbers collected for text messaging consent will not be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes.

11. GOVERNING LAW & SEVERABILITY

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Rhode Island, without regard to its conflict of law principles. Any legal action or proceeding arising under these Conditions shall be brought exclusively in the state or federal courts located in Rhode Island. If any provision is found to be unenforceable, the remaining provisions shall remain in full force and effect.
